Appointment and Authorization

Seller appoints Hawkins Real Estate Services, through its licensed broker Joseph E. Hawkins, as the limited-service listing broker for the purpose of advertising and placing the Property into the applicable Multiple Listing Service (MLS). This Agreement is intended to constitute a limited-services agreement and not a full-service listing agreement.

The term of this Agreement is six (6) months from the date of execution unless the Platinum Plan is selected, which includes a twelve (12) month term. Extensions may be requested for an additional fee.

Services include MLS entry, forwarding inquiries, MLS compliance assistance, listing administration, and any additional brokerage support according to the plan selected by Seller. Broker's duties are limited to the services specifically described in this Agreement. Additional representation or brokerage services must be agreed to separately in writing.

Hawkins Real Estate Services does not provide legal advice, contract drafting, or contract interpretation. Seller is solely responsible for reviewing and understanding all contracts, disclosures, addenda, and transaction documents. Seller is encouraged to consult with an attorney regarding any legal questions or concerns.

Administrative Fees

Any closing-based fees associated with the selected service plan shall be collected at settlement through the title company and deducted from Seller's proceeds.

Seller agrees to provide Hawkins Real Estate Services with a copy of the ALTA Settlement Statement or Closing Disclosure prior to settlement and a final signed version after settlement. The Seller remains responsible for any closing fee due under the selected plan if the property goes under contract during the term of this Agreement and subsequently closes, regardless of whether settlement occurs before or after the listing expiration date.

Communication and Contact Information

Buyer and agent inquiries may be forwarded to Seller by phone, text message, email, or call-forwarding technology.

Seller contact information shall comply with MLS rules and may only appear in locations permitted by the MLS.

Seller agrees to respond promptly to buyer and agent inquiries and to keep all contact information current throughout the listing term.

Showing Services

If Seller elects to use ShowingTime or another showing service, Seller remains responsible for scheduling, approving, and managing all showings and communications. Activation of a showing service does not create additional brokerage duties beyond those stated in this Agreement.

MLS Listing Rules, Accuracy, and Changes

Seller agrees to:

Submit all listing changes to joe@hawkinsrealty.com or through the Hawkins Real Estate Services website
Ensure all property information, disclosures, room sizes, and listing details are accurate
Use only authorized photographs, videos, and marketing content
Comply with all MLS rules, Fair Housing laws, and applicable regulations
Notify Broker promptly of contract acceptance, status changes, or closing. Seller certifies that all information submitted for MLS entry, including property details, room dimensions, photos, disclosures, pricing, and remarks, is accurate and complete to the best of Seller's knowledge.

Standard listing changes are generally processed within 24 hours. Platinum Plan updates are generally processed within 12 hours.

Seller is responsible for any MLS fines, penalties, or fees resulting from inaccurate information, unauthorized content, copyright violations, noncompliance with MLS requirements, or Fair Housing violations.

MLS Marketing and the Internet

The Multiple Listing Service (MLS) supports an open and cooperative marketplace by making property information available to licensed real estate brokers and agents. MLS data may be distributed to participating brokers, agents, and approved third-party real estate websites.

Seller acknowledges that properties entered into the MLS may be displayed on consumer-facing websites, including but not limited to Zillow, Realtor.com, Redfin, brokerage websites, and other MLS syndication partners, subject to MLS rules and policies.

Broker does not control the accuracy, timing, display, or removal of listing information on third-party websites and is not responsible for delays or errors caused by MLS syndication or third-party platforms.

Buyer Agent Compensation

Compensation to Cooperating Brokers/Agents: Seller further authorizes Broker to offer compensation to cooperating brokers/agents in the event they procure a ready, willing, and able buyer for the property. Seller acknowledges and agrees that any compensation offered to cooperating brokers/agents is paid by Broker from the commission due under this Agreement and does not increase Seller’s total commission obligation. Seller shall determine any compensation offered to buyer agents. Any “lease-related” agent compensation shall be negotiated directly between Seller and the Tenant Agent unless otherwise agreed in writing.

Broker is providing limited-service brokerage services and is not acting as a traditional full-service listing agent unless otherwise agreed to in writing.

Except for services included in the selected plan, Seller is responsible for scheduling showings, responding to buyers and agents, negotiating offers and contract terms, and managing transaction-related communications.

Broker's duties are strictly limited to the services expressly stated in this Agreement and the Seller's selected service plan.

Seller Responsibilities

Except for services specifically included in the selected service plan, Seller is responsible for conducting showings, responding to buyers and agents, negotiating offers, completing disclosures, managing contracts, and coordinating the transaction through closing. Seller agrees to notify Broker immediately upon acceptance of a contract, cancellation, withdrawal, closing, lease execution, or any status change required by MLS rules. Seller is solely responsible for providing accurate showing instructions, property access information, lockbox management, alarm codes, occupancy information, and security arrangements. Broker shall not be responsible for unauthorized access, property damage, theft, or losses arising from property showings or access arrangements. Seller acknowledges that Broker recommends consultation with an attorney regarding contracts, disclosures, and legal obligations associated with the sale or lease of the Property.

Seller Warranties

Seller represents that Seller is the owner of the Property or has full authority to enter into this Agreement.
Seller is responsible for the accuracy of all property information, disclosures, room sizes, pricing, photographs, and listing content provided to Broker.
Seller represents that all photographs, videos, virtual tours, floor plans, and marketing materials submitted to Broker are owned by Seller or used with proper authorization.
Seller agrees to comply with all applicable laws, MLS rules, and Fair Housing requirements.

Seller agrees to indemnify and hold Hawkins Real Estate Services harmless from claims, damages, fines, or liability arising from inaccurate information, unauthorized content, copyright violations, or Seller's failure to comply with applicable laws or MLS requirements.

MLS Fines and Fair Housing Compliance

Seller is responsible for any MLS fines, penalties, or fees resulting from:

Unauthorized photographs, videos, or other marketing content
Misleading, inaccurate, or incomplete listing information
Copyright violations or unauthorized use of content
Discriminatory language or Fair Housing violations
Failure to comply with MLS rules or required status updates

Seller agrees to comply with all applicable Fair Housing laws and MLS regulations. Seller shall be responsible for any fines, penalties, damages, or claims arising from Seller-provided information or noncompliance with applicable laws, regulations, or MLS requirements. Seller acknowledges that Broker does not control the timing, accuracy, display, removal, or synchronization of listing information on third-party websites and shall not be responsible for delays or data discrepancies caused by MLS syndication partners.

MLS & Fair Housing Acknowledgment(Required)

I understand I am responsible for MLS fines caused by inaccurate or unauthorized content.

Fair Housing Compliance

Seller agrees to comply with all applicable federal, state, and local Fair Housing laws and regulations. Seller shall not use discriminatory language or engage in discriminatory practices in the marketing, advertising, sale, or lease of the Property. Seller is responsible for ensuring that all information provided for the MLS listing complies with Fair Housing requirements.

I agree to comply with all federal Fair Housing laws.

Seller Disclosure Obligations

Seller acknowledges that state and local laws may require disclosure of known material facts affecting the value, condition, or desirability of the Property.

Seller is solely responsible for completing and providing all required property disclosures and for ensuring that all information provided to Broker, prospective buyers, and cooperating agents is accurate, complete, and current.

Broker does not provide legal advice and is not responsible for determining which disclosures are required by law. Seller is encouraged to seek legal counsel regarding disclosure obligations when necessary.

Disclosure Acknowledgment(Required)

I understand my obligation to disclose all known material facts.

Seller acknowledges that real estate transactions are frequently targeted by cybercrime and wire fraud. Broker will never send wire instructions by unsecured email. Seller agrees to independently verify all wiring instructions directly with the settlement company before transmitting funds.

Brokerage Relationship Disclosure

Broker is providing limited-service brokerage services only. Unless otherwise agreed in writing, Hawkins Real Estate Services is not acting as a traditional full-service listing agent and Broker's duties are limited to the services expressly described in this Agreement and the Seller's selected service plan.

Hawkins Real Estate Services operates under the trade name Joe Hawkins Realty in Pennsylvania and Hawkins Real Estate Services in Virginia.

Electronic Signatures

Seller agrees that this Agreement and any related documents may be executed electronically. Electronic signatures shall have the same legal force and effect as original handwritten signatures. Seller consents to receive communications from Broker through email, text message, telephone calls, and electronic document platforms for purposes related to this transaction.

Brokerage Relationship Acknowledgment(Required)

I understand that Hawkins Real Estate Services is providing limited-service brokerage services as described in this Agreement.

Termination

Seller may cancel this Agreement at any time by providing written notice, provided the Property is not under contract. Upon cancellation, Broker will remove the listing in accordance with applicable MLS rules.

Broker may rescind this Agreement within seven (7) business days of execution.

Any upfront fees previously paid are non-refundable once the listing has been activated in the MLS. Any closing-based fees remain due if the Property goes under contract during the term of this Agreement and the transaction subsequently closes, regardless of whether settlement occurs before or after the listing expiration date.

Indemnification

Seller agrees to indemnify, defend, and hold Hawkins Real Estate Services harmless from any claims, damages, losses, fines, penalties, liabilities, costs, or legal expenses arising from:

Inaccurate or incomplete information provided by Seller
Unauthorized photographs, videos, virtual tours, or other marketing materials
Copyright or intellectual property violations
MLS rule violations resulting from Seller-provided information
Fair Housing violations or discriminatory marketing content
Seller's failure to comply with applicable laws, regulations, or disclosure requirements

Seller acknowledges responsibility for all information and content submitted for marketing the Property and agrees to indemnify and hold Broker harmless from any resulting claims or liabilities. Broker shall not be liable for indirect, consequential, incidental, special, or punitive damages arising from services provided under this Agreement. Broker's liability, if any, shall not exceed the fees paid by Seller under this Agreement.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state in which the Property is located. Electronic signatures shall be valid and enforceable to the fullest extent permitted by law.

Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, representations, understandings, and agreements regarding the subject matter of this Agreement.

Any amendment, modification, or waiver of any provision of this Agreement must be in writing and signed by all parties.
