Appointment and Authorization

Seller appoints Hawkins Real Estate Services, LLC, through its licensed broker Joseph E. Hawkins, as Limited Listing Broker solely for the purpose of placing the Property into the applicable Multiple Listing Service (MLS) and providing the limited services expressly stated herein. This Agreement is intended to constitute a limited services agreement and not a full-service listing agreement.

The term of this Agreement is six (6) months (12 Month under Platinum plan) from the date of execution unless earlier terminated. Extensions may be purchased for $100, if requested at least three (3) days prior to expiration.

Scope of Limited Services

Broker’s services are limited to:

Entry of the property listing into Stellar MLS
Forwarding buyer/agent inquiries to Seller
Basic MLS compliance assistance
Optional additional limited services (“brokerage support”) for Silver and Platinum plans

Broker’s services are strictly limited to MLS entry, basic compliance support, forwarding inquiries to Seller, and any additional services expressly selected by Seller. Broker does not provide representation, negotiation, or contract drafting unless separately agreed to in writing or the customer upgrades to the Silver or Platinum plan.

Listing Fees and Payment

Upfront, nonrefundable fees:

Rental Listings: $125
For Sale Listings: $295

Payment methods: Zelle (preferred), Venmo, CashApp, Stripe.

Listing activation requires full payment and all required documents.

Seller must submit:

Completed Stellar MLS Data Sheet
Property photos in JPG format only
Required local or state disclosures

Once documents are received, Broker will prepare a draft MLS listing for Seller review. Upon written approval, the listing will be made Active.

Administrative Fees

Administrative fees (if applicable, such as upgraded Silver and Platinum plans) are paid at closing and deducted from Seller proceeds. Seller must provide a copy of the ALTA/CD to Hawkins Real Estate Services prior to settlement.

MLS Listing Rules, Accuracy, and Changes

Seller agrees to:

Submit all changes to joe@hawkinsrealty.com or via the website
Ensure all information is accurate and lawful
Use only authorized photos and content
Comply with MLS rules and Fair Housing laws

Broker will process changes within 24 hours.

Seller is responsible for all MLS fines (+$100) resulting from inaccurate data, unauthorized photos, or prohibited language.

MLS Marketing and the Internet

Bright supports an open, transparent market for property information by requiring subscribers (licensed agents and brokers) to cooperatively share information about all available properties and make them available to subscribers in the area on an impartial basis.

Buyer Agent Compensation

Seller agrees to offer compensation to a cooperating Buyer’s Agent:

For Rentals: No agency relationship is created. Tenant Agent compensation is negotiated directly between Seller and Tenant Agent. Hawkins Real Estate Services will not pay Tenant Agents.

MLS Fines and Fair Housing Compliance

Seller is responsible for any MLS fines resulting from:

Unauthorized photos
Misleading or inaccurate information
Discriminatory language
Late status updates

Minimum fine: $100. Photo copyright violations may exceed $500.

Florida Fair Housing Compliance

The Property shall be offered without regard to race, color, religion, sex, handicap, familial status, national origin, or any other protected class under federal, state, or local law.

Indemnification

Seller agrees to indemnify and hold Broker harmless from all claims, losses, fines, or legal expenses arising out of inaccurate information, MLS violations, or Fair Housing violations.

Governing Law

This Agreement shall be governed by the laws of the State of Florida.
